Terms of Service

By accessing or using surstreaming (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

surstreaming provides a real-time text-to-speech platform for TikTok Live streamers. The Service reads chat comments, gifts, and live events aloud during streams using AI-powered voice synthesis.

Voice synthesis may run in your browser, on our servers, or through third-party cloud text-to-speech providers (including Fish Audio). When you connect your own API key for a cloud provider, your content is processed by that provider under its own terms and billed to the account you own.

Access tiers include a free trial and a paid plan. Paid plans are billed monthly through Stripe, our authorized payment processor.

You must be at least 18 years old and hold a valid TikTok Live-enabled account, as required by TikTok's Terms of Service. By using surstreaming you represent that you meet the TikTok requirements to go live.

Authentication is handled exclusively via TikTok OAuth. You are responsible for all activity that occurs under your account. Do not share your session credentials. We reserve the right to suspend accounts that violate these Terms.

• Free Trial: Free users receive a three-hour trial every week at no charge.
• Paid Plan: €1.99/month plan is billed in advance on a monthly cycle.
• Payment Processing: All payments are processed by Stripe. By completing the payment, you agree to Stripe’s terms.
• Cancellation: You may cancel at any time through the Member Portal. Access continues until the end of the current billing period.
• Refunds: Refund requests submitted within 7 days of initial purchase will be accepted at surstreaming-support@sahin.tech. This voluntary goodwill refund is in addition to — and does not replace or shorten — your statutory rights, in particular the 14-day right of withdrawal for EU consumers described in Section 14.
• Immediate availability: The paid plan is made available after purchase. Your statutory right of withdrawal described in Section 14 remains unaffected. You may also cancel the subscription at any time through the Member Portal.

You agree not to:

• Use the Service to transmit illegal, harmful, or harassing content. Suppressing those contents from chat comments with the strict filter option in TikTok is recommended.
• Attempt to reverse-engineer, scrape, or abuse the Service infrastructure.
• Circumvent subscription restrictions or access controls.
• Resell or sublicense access to the Service without written permission.

The Service synthesizes speech with AI voice models. Two engines are available: the open-weight Supertonic-3 model (which runs in your browser or on our servers) and the cloud Fish Audio engine. Each carries its own licence and terms; by using an engine you agree to the restrictions that apply to it.

Fish Audio (cloud engine): When you select the Fish Audio engine, the text to be read (chat comments, gifts, and viewer display names) is transmitted to Fish Audio, a cloud text-to-speech provider operated by Hanabi AI Inc. in the United States, and processed there. If you connect your own Fish Audio API key, you agree to Fish Audio’s Terms of Use. You remain responsible for the content you synthesize with your own Fish Audio account, and usage is billed by Fish Audio to that account. Fish Audio’s terms permit it to use the content and usage data you submit to develop, train, or improve its AI models.

API keys: If you add your own Fish Audio API key, it is stored only in your browser’s local storage. When you use the Fish Audio engine, the key may temporarily pass through our synthesis endpoint solely to forward the request to Fish Audio, where it is used to authenticate and bill the request. We do not intentionally log or store the key. The key is used solely to authenticate and bill the request with Fish Audio and is not used by us for any independent purpose. The text to be synthesized is transmitted to Fish Audio for processing. You are responsible for keeping your key secure and for all usage billed to your Fish Audio account. You may not buy, sell, share, or transfer API keys.

AI disclosure: You may not present AI-generated speech as entirely human-generated. When you distribute content synthesized through the Service, you must disclose that it was created using artificial intelligence technologies.

Attachment A — Prohibited Uses (applies to all TTS engines):

• (a) Illegal Use: Using any TTS engine in any way that violates applicable national, federal, state, local or international law or regulation.
• (b) Harm to Minors: Exploiting, harming or attempting to exploit or harm minors in any way.
• (c) Disinformation: Generating or disseminating verifiably false information with the purpose of harming others.
• (d) Personal Data Misuse: Generating or disseminating personal identifiable information that can be used to harm an individual.
• (e) Undisclosed AI Content: Generating or disseminating AI-generated content without expressly and intelligibly disclaiming that it is machine generated.
• (f) Harassment: Defaming, disparaging or otherwise harassing others.
• (g) Impersonation / Deepfakes: Impersonating or attempting to impersonate others (e.g. deepfakes) without their consent.
• (h) Automated Legal Decisions: Fully automated decision making that adversely impacts an individual's legal rights or creates binding, enforceable obligations.
• (i) Behavioral Discrimination: Discriminating against or harming individuals or groups based on online or offline social behavior or personal characteristics.
• (j) Exploitation of Vulnerable Groups: Exploiting vulnerabilities of persons based on age, social, physical or mental characteristics to distort behavior in a way that causes physical or psychological harm.
• (k) Protected Characteristics Discrimination: Discriminating against individuals or groups based on legally protected characteristics or categories.
• (l) Medical Advice: Providing medical advice or medical results interpretation.
• (m) Justice & Law Enforcement: Generating information for use in administration of justice, law enforcement, immigration or asylum processes, such as predicting fraud or criminal behavior.
• (n) Competing Models: Using output from any TTS engine to develop models that compete with that engine’s provider (as restricted by Fish Audio’s Terms of Use and the Supertonic-3 OpenRAIL-M licence).

All content, branding, and software comprising surstreaming are owned by or licensed to us. Your TikTok content remains yours. You grant us a limited licence to process your stream data solely to deliver the Service.

The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted availability or that the Service will meet all your requirements.

Nothing in this Section limits or excludes statutory rights and consumer protections that apply to you under mandatory applicable law, in particular German and European consumer law.

To the maximum extent permitted by law, surstreaming shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for damages is limited to the amounts paid by you in the 3 months preceding the claim.

The limitations in this Section do not apply to liability for intent or gross negligence (Vorsatz und grobe Fahrlässigkeit), for damage to life, body, or health, for claims under the German Product Liability Act (Produkthaftungsgesetz), for fraud, or to any other liability that cannot be excluded or limited under mandatory applicable law. To the extent we are liable for a breach of essential contractual obligations (Kardinalpflichten), our liability is limited to the damage that is typical and foreseeable for this type of contract.

We may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of the Federal Republic of Germany, without prejudice to mandatory consumer protection provisions applicable in the country of your habitual residence.

If you are a consumer, you may bring proceedings before any court competent under the mandatory consumer-protection laws applicable to you.

If you are a consumer (a natural person acting for purposes wholly outside your trade, business, craft, or profession) with a habitual residence in the European Union, you have the statutory right to withdraw from your purchase of a paid subscription within fourteen (14) days without giving any reason.

Withdrawal period: The withdrawal period is fourteen (14) days from the day on which you conclude the contract (for a subscription, the day you purchase the plan).

How to withdraw: To exercise your right of withdrawal, you must inform us of your decision by an unequivocal statement (for example, a letter or an email to surstreaming-support@sahin.tech) before the expiry of the withdrawal period. If you have an active paid subscription, you may also withdraw electronically with the “Withdraw from contract” button in the Member Portal. You may use the model withdrawal form below, but it is not required. To meet the deadline, it is sufficient that you send your statement before the withdrawal period expires.

Consequences of withdrawal: If you withdraw from this contract, we shall reimburse all payments we have received from you, without undue delay and in any event no later than fourteen (14) days from the day on which we are informed of your decision, using the same means of payment that you used for the initial transaction. No reimbursement fee will be charged.

Withdrawal and digital services: The paid plan is a continuous digital service provided online. We do not ask you to request performance before the withdrawal period ends or to waive your statutory right of withdrawal. Your statutory right to withdraw therefore remains available throughout the withdrawal period.

If you withdraw, we will reimburse payments in accordance with applicable law. Cancellation of the subscription under Section 5 prevents future renewals but is separate from exercising the statutory right of withdrawal.

Where applicable law permits a deduction for services supplied before withdrawal, any such deduction will be calculated only as permitted by that law and will be communicated to you.

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless required by mandatory applicable law.

Consumers may contact their local European Consumer Centre or another competent consumer protection authority for information about available out-of-court dispute resolution options.

Nothing in this Section limits any statutory rights you may have to bring proceedings before a competent court.
